Peak Systems – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Peak Systems platform (“Platform”), operated by Twin Peaks Project Services LLC (“Company,” “we,” “our,” or “us”).

By accessing or using Peak Systems, you agree to be bound by these Terms.

1. Overview of Service

Peak Systems is a cloud-based project management platform designed for facilities, property management, and building operations teams.

The Platform is intended for internal use by authorized users of a subscribing company.

2. Eligibility

You must be at least 18 years old and authorized by your company to use the Platform.

3. Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activity under your account

  • Ensuring your use complies with applicable laws

You agree not to share accounts or provide unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Platform for unlawful purposes

  • Upload malicious code or harmful content

  • Attempt to gain unauthorized access to systems or data

  • Interfere with system performance or security

5. Data and Ownership

Your company retains ownership of all project data entered into the Platform.

You grant the Company a limited license to host, process, and display this data solely for providing the service.

6. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted access.

The Platform may experience downtime, maintenance, or updates.

7. Limitation of Liability

To the maximum extent permitted by law, Twin Peaks Project Services LLC shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of data, profits, or business opportunities

  • Errors, omissions, or interruptions in service

8. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

We make no warranties regarding:

  • Accuracy or completeness of data

  • Fitness for a particular purpose

  • Continuous or error-free operation

9. Termination

We reserve the right to suspend or terminate access if these Terms are violated.

10. Modifications

We may update these Terms from time to time. Continued use constitutes acceptance of updates.

11. Governing Law

These Terms are governed by the laws of the State of Arizona.
