Peak Systems – Beta Program Terms and Waiver

Effective Date: April 11, 2026

Peak Systems is currently offered as a limited-access beta product. By using the Platform, you acknowledge and agree to the following:

1. Beta Status

The Platform is in an early testing phase and may contain:

• Bugs or errors

• Incomplete features

• Unexpected behavior

Functionality may change at any time without notice.

2. No Reliance

You agree not to rely on the Platform as the sole source of truth for:

• Financial decisions

• Project execution

• Compliance or regulatory reporting

You are responsible for independently verifying all information.

3. Data Risk

While reasonable efforts are made to protect data, you acknowledge that:

• Data loss or corruption may occur

• Features may not function as intended

• Backups are not guaranteed during beta

4. Limitation of Liability

To the maximum extent permitted by law, Twin Peaks Project Services LLC shall not be liable for any damages arising from use of the beta Platform, including:

• Data loss

• Project delays

• Financial impacts

• Operational disruptions

5. Feedback

You may provide feedback or suggestions. You grant the Company the right to use this feedback without restriction or compensation.

6. Service Changes

We may modify, suspend, or discontinue the Platform at any time.

7. No Guarantees

No guarantees are made regarding:

• Availability

• Performance

• Feature completeness

8. Acceptance

By using Peak Systems during the beta period, you acknowledge that you understand and accept these risks.

9. Governing Law

This agreement is governed by the laws of the State of Arizona.
